Women Obesity and Pregnancy Complications

According to the Public Affairs Committee there is a correlation between women obesity and pregnancy complications. The report suggests that women having a body mass index (BMI) greater than 30 have, compared to normal weight women, double the risk of having an affected child.

This relation remains unclear because of limited available data. But statistics show that obese and overweight women face during pregnancy an increased risk of gestational diabetes, hypertension and thromboembolic events. At the same time they are more likely to need a cesarean surgery.

In addition, the babes of obese mothers have higher chances to start their life in neonatal intensive care units and have a higher incidence of neural tube troubles.

Because childhood obesity is a major social concern, the Public Affair Committee consider that prevention of this condition must begin with prevention of obesity during the reproductive years. By consequence, the report suggests to avoid obese or overweight conditions during the pregnancy. Because during the pregnancy an adequate nutrition is recommended for women, the weight loss efforts must be made before conception. During the pregnancy women should receive a appropriate education about the right caloric intake and exercise.

The last recommendation of Public Affairs Committee says that all parents should be educated to pay a special attention of breastfeeding and proper childhood nutrition as a protective approach against childhood obesity.

Ademption: When The Property Left In The Will Is Not In The Estate At Death

Ademption defined

Ademption occurs when the property that the Will leaves to someone is not in the decedent's estate when the decedent dies. The bequest is said to adeem, and it lapses.

A brief review of Will provisions that transfer property

The generic term for a Will provision that leaves something to a person is called a bequest. If the property bequeathed is personalty (such as cash, securities, cars, collectibles, jewelry and heirlooms), it is called a legacy and the person receiving it is a legatee. If the property is real estate, it is called a devise and the person receiving it is a devisee. If the Will provision at issue says "I leave the rest, remainder, and residue of my estate to X," it is called a residuary bequest. Here's where it can get tricky: If the Will says "I leave 100 shares of ABC Corp. stock to X," it is considered a general bequest and the beneficiary would receive the date of death value of 100 shares of that particular stock. However, if the possessive "my" is added and the Will says "I leave my 100 shares of ABC Corp. stock," it is considered a specific bequest and the beneficiary would receive the testator's 100 shares of that particular stock if he owned it at the time of death.

By its nature, therefore, ademption applies only to specific bequests (i.e., specific legacies of personal property or specific devises of real property) where identifying the specific asset intended is important - not to general, residuary or demonstrative bequests. This makes sense since it follows that an ademption would be relevant if "the 1964 red Corvette I inherited from my grandfather," or "123 Main Street," are no longer owned by the testator at the time of his death, while ademption would not be relevant to a bequest of $1,000 or "the residue of my estate".

There are two kinds of ademption

Ademption by extinction means the property is not in the testator's estate at the time of death because it was transferred, substantially changed, or destroyed before the testator's death. Let's say your father leaves you his comic book collection in this Will, but after he signs his Will he sells the collection and invests the proceeds in an emu ranch. Upon his death, you get neither the comic book collection nor the emu ranch nor the value of these assets. The bequest would adeem by extinction.

Ademption by satisfaction means that the property is not in the testator's estate because it was already intentionally transferred by the testator to the beneficiary. In our example, if your father gifted you his comic book collection during his life, that bequest would adeem by satisfaction. Ademption need not totally eliminate the bequest - there can even be partial ademption under certain circumstances.

The test for ademption turns on the physical existence of the property, not intent. According to the traditional view of ademption this did not matter; knowledge or intention by the testator was irrelevant. The important question was not whether the testator intended to extinguish a specific gift by disposing of the property, but simply whether the property was part of the estate when the testator died. However the testator's intent is relevant in will construction regarding whether an alternate gift was intended, or whether a bequest was meant to be general disposition rather than a specific fund.

Anti-ademption statutes

Some states have anti-ademption statutes which prevent a bequest from adeeming. For example, New York's Estates, Powers and Trusts Law (EPTL) 3-4.3 provides that property conveyed by Will, if altered but not wholly divested, does not revoke such bequest, but the estate in the property that remains in the testator passes to the beneficiaries. Similarly, Section 3-4.4 provides that a conveyance made by a committee or conservator, during the lifetime of its incompetent or conservatee, of property that had been specifically bequeathed in that individual's will, does not cause the bequest to adeem. EPTL 3-4.5 provides that insurance proceeds paid after the testator's death on property that had been specifically devised are to pass to the intended beneficiary of the property (note that this applies solely to proceeds paid after the testator's death).

In Wisconsin, state law attempts to abolish the common law doctrine of ademption by extinction, by, for example, awarding beneficiaries the balance of the purchase price of the item sold (subject to some limitations). In Virginia, ademption occurs with respect to most forms of property, but if the property at issue is stock certificates where the issuer of the stock has been bought out by another company and that the stocks have been swapped for stock in the new company, the bequest will not adeem. Similarly, if the shares of stock that existed at the time the gift was made have split (for example, where the holder of 500 shares receives a reissue of 1,000 shares each having half the value of the original), then the beneficiary of that bequest will be entitled to the number of shares that exist after the split.

In an Alabama case where the testator devised his real property - including all right, title, and interest in and to real property acquired by inheritance or otherwise from his predeceased wife - to a single individual, and the testator then sold part of the inherited realty and took back a purchase money mortgage, the court held that under the applicable anti-ademption statute, the devisee would receive the outstanding balance on the mortgage. In states lacking an anti-ademption statute, this type of tracing would not occur and the devise would adeem.

Analysis and recommendations

Needless to say, the possibility of ademption can be anticipated when a Will is drafted and appropriate wording used to avoid ambiguities. To avoid confusion and any ambiguity regarding whether something will be adeemed, it is prudent to use the phrase "if owned by me at the time of my death" in the Will when referring to the asset being bequeathed. Similarly, ademption will not occur if a testamentary gift of property is expressed to give the property or any proceeds of its sale, transfer or other form of disposition. On this view, the gift of property would likely extend to the proceeds of the sale of the asset and would almost certainly overcome any possible ademption. The issue could be placed beyond doubt if such a clause were expressed as applying not simply to the proceeds of the sale but also to any insurance, bond, deposit, surety, interest or license that accrues by reason of the sale and investment of the proceeds of the property. If a testamentary gift is expressed in such terms, the beneficiaries would take whatever remains of the proceeds of sale on the death of the testator.

2012, Presidential Election

The 2012 Presidential election is going to be interesting. While the world watches, many interesting and fascinating events will occur. I know it is said every election, at least in the last 15 years, but this is the most critical election in modern time. The fate of not only the United States, but the entire free world as well,hangs in the balance.

Do we continue on the path to destruction by embracing socialism and even worse Marxism, or do we find our way back to what our founding fathers intended for this country and the world, freedom and a place where mankind could reach it's highest potential without the interference of government.

As has already been evidenced, many individuals will play a part in this election, and each will play a major role in the final outcome. The moment I saw Sarah Palin in 2008 I knew she would be a major player and possibly president someday. Everyone seems to forget, John McCain and Sarah were leading the 2008 presidential polls, until the financial crisis which conveniently occurred 5 weeks before the election.(October surprise?)

She was without a doubt the first to speak out, her boldness set the way for others to follow, as a result she took much heat for this. Such is the plight for trend setters. Many see her as radical, this just goes to show how far our country has drifted from the path originally set by our founding fathers. In today's world John Kennedy and Ronald Reagan would be labeled extreme and would have little chance of getting elected to anything.

Following Governor Palin came Michelle Bachmann, Ron Paul, Rick Perry and others, each contributing much to the campaign. Although most have fallen out of the hunt as of today, they still continue to contribute and slowly educate the American citizen as to the virtues of their beliefs.

Deep down, most people know that what they are saying is true, however, people have been so mis-educated by not only the media, but our educational system and misinformed parents as well, they have lost sight of the basic values we as human souls are all instilled with.

People have been so indoctrinated by a society that teaches many to be dependent on government and their entitlements and the misconception it creates. Many believe that life is easier if someone does everything and pays for everything for them. This may be true for a while, but sooner or later, there is a price to pay, the one with the money is the one in control of your life. Do you want the government in control of your life.

This election will determine the fate of not only the United States and it's citizens but the fate of the world for many years to come. Do we want to continue down the path of socialism and destruction, or do we want to gradually return to the values and work ethic our country was founded on?

Do we want to take the easy way out, or do we want to return to the time tested values that have sustained generations of people throughout the ages? Do we want to put forth a little extra effort to guarantee of life similar to ours for generations of our descendants, or do we want to sentence them to a life of subjugation and poverty, a life with little freedom and opportunity?

Self Esteem and Self Confidence - The Keys in your Pursuit of Happiness and your Goals

I can't believe it. I was watching the news this morning and they had a segment on food allergies. They suggested making little card that you could give to waiters or waitresses that outline your food allergy because it is embarrassing to talk about it. WHAT! Why in the hel would it be embarrassing to talk about a food allergy?

The only reason is because the person with the allergy has no self-confidence or is just a wimp. I could not believe it. If you have a food allergy then it would seem that talking to a waiter, who is bringing you your food, would be a reasonable thing.

This idiot is crying about how embarrassing it is. What is this guy trying to do, enable this kind of low self-esteem. What kind of crap is this guy spreading. My wife was laughing at me when my face turned three shades of purple. What really made me mad was that he was weakening people instead of trying to strengthen them. Giving them a card because they may be embarrassed suggests, to me, that maybe they should be embarrassed. The idea of being embarrassed because of a food allergy is stupid, but this guy is teaching people to feel that way.

Our whole society does that. Teaches people to be embarrassed about their wrinkles, or eye color, or lack of hair, or on and on. This kind of stuff hurts people more than anyone can measure.

This is just a symptom of why so many people are not living the lives they want. You can't be scared of what others will think. If you are scared of what a waiter will think of a food allergy, that is not your fault, then what will you do when you have to make a tough choice. You will take the path that will get you the approval of the most people, the problem is that path is likely the most destructive to you and your life.

If you don't think I have gotten my share of teasing and nasty email from friends and acquaintances about my book "The Barbarian's Guide to Success" your crazy. Just last Sunday I was at a friends house and he started to tease me it. I never batted an eye, I just said with conviction that he would do well to buy a copy and read it. Instead of trying to seek his approval, I just stuck to my guns, and guess what I got his approval. I didn't need to ask him for it. I didn't need to try and get it. I didn't even care if I did get it. Just stick to your guns and most people will come to you, because they like that sort of confidence.

Most people are attracted to confidence. The key is developing it. I talk at length about developing your confidence in "The Barbarian's Guide to Success." I still can't imagine a Barbarian with low self esteem. The idea makes me laugh, hence the name.

For the ones who are not attracted to confidence, well who cares. You know, some people are going to come with you on your journey. They will want to be part of your group, growing and enjoying life more and more each day. Some people won't. I, personally, really don't care about them, and you shouldn't either.

Who cares what that moron at work thinks, you know the one. He is always criticizing everyone. Then he drives his gremlin home to his empty one bedroom apartment. Who cares what he thinks. Lift you head high and people will come with you.

An Introduction to Wainwright's Lake District

Alfred Wainwright is has been called amongst other things, "the greatest fellwalker." His written works and subsequent television footage have helped turn fellwalking into a national pastime over the past decades.

Walking has many benefits. It puts all participants on a level playing field. Access to the mountain fells of the Lake District is free of charge, and the "lack of rules" means that it is up to the individual to follow their own agenda. Distance, route and speed is all simply up to you. Walking was there before Wainwright, but he played a huge part in bringing it to the masses with his no nonsense approach.

I was a late starter, with my exploration of the Lakes beginning after I had turned thirty five. My first Lakeland fell was a bit of a disaster. Doing exactly what you shouldn't do, a fellow beginner and I set off with the wrong gear, no guidebook, and no map other than a 50p leaflet to guide us. Oh and the leaflet was soaked through within the first fifteen minutes and of no use to us; fortunately we remembered the instruction to "turn left at the telegraph pole." Funnily enough that actually helped, and we almost made it to the summit of Coniston Old Man, but bad weather made us turn back. Soaked through, cold and facing failure, we loved it!

A couple of days later my walking partner and I managed to reach the summit of our first Lakeland Fell, Catbells. Not a giant amongst fells by any means, but there it clicked. Stood next to the summit cairn, beside schoolchildren, grandmothers and their pets, it became blindingly obvious why people do it week in week out.

So there it was, I had conquered one of the "214 Wainwrights." That discovery was pleasing rather than depressing as it meant that fun and adventure to be had in the Lake District would be there for years to come.

I also realised that a little preparation goes a long way in the Lake District. Guide books and maps are all there for good reason, and a little investment has gone onto greatly improve my appreciation and enjoyment of the area. When I am unable to go out on walks I am able to stay at home, read the guidebooks, history books and photographic documents to enjoy and prepare for trips ahead. A couple of years down the line, having "conquered" many more of the great Lakeland fells, the adventure has just begun.
